The world is beginning to see a decline in democracy with a corresponding increase in authoritarianism. The world is also witnessing the formation of regions of countries. Some of these regions promote democracy in their trade treaties via democracy clauses. This thesis will assess the effectiveness of these democracy clauses at ensuring a constitutional separation of powers with judicial independence in Member States. This will be achieved through a comparative analysis of countries within three different regions: European Union (EU) Association Agreements in the Eastern Partnership (EaP); Mercosur; and ASEAN. Once this effectiveness is ascertained, possible ways of strengthening democracy clauses will be explored. The culmination of the research will be a rewritten or modified democracy clause for each region which promotes judicial independence.
